Article 1: Scheduling
1.1
NextContext offers language courses for individuals as well as for companies, non-profit organizations and government agencies. For some courses, our website (nextcontext.eu) provides information about class schedules and locations. However, for organizational reasons, schedules and other parameters may differ from the information on our website. NextContext makes every effort to keep these differences as small as possible. In most cases, schedules and other parameters are determined by mutual agreement.
1.2
NextContext offers language courses in small groups as well as on a one-to-one basis. Group courses usually follow a fixed schedule, while one-to-one courses are usually scheduled by agreement between the student and the teacher. There are, however, exceptions to this general rule.
Article 2: Group Classes
2.1
NextContext organizes groups by language level. The school reserves the right to tolerate as little difference as possible between the levels of the participants in a given group.
Article 3: Registration
3.1
Some students enroll directly with NextContext, while others enroll through a representative of their company or other organization. Regardless of how a student enrolls, the school has the sole discretion to select and assign a teacher to the student. The student acknowledges and agrees that he or she does not have the right to choose the language teacher, except in the case of individual lessons purchased by the student. In the latter case, the school reserves the right to take the student's preferences into account when assigning a teacher, to the extent feasible given available resources and scheduling considerations.
3.2
If a student's enrollment is completed less than 4 days prior to the start of the course, the school reserves the right to postpone the start of the course by one week.
Article 4: Payment
4.1
The prices indicated on our site and in our offers are valid for a period of 30 days.
4.2
Our invoices are payable in full at the latest 1 month after the invoice date. In the event of late payment by an individual, company, non-profit organization or government agency, the amount due will be increased by the legal interest rate of 4%, in accordance with the law and without notice of default.
4.3
In addition, in the event of late payment, the amount due shall be increased automatically and without notice by a flat-rate penalty of 15%, with a minimum of 60 euros, without prejudice to the right of the school to claim a higher compensation if the damage exceeds the amount of this penalty clause.
4.3
Finally, in the event of late payment, whether by the student or by the organization that enrolled the student, the school may refuse admission to the course until the amount due is paid. The missed lessons will not be replaced or refunded.
Article 5: In-person classes
5.1
NextContext reserves the right to replace in-person classes with online classes for any reason.
Article 6: Cancellation
6.1
The client can only cancel his language course if he informs NextContext before the start of the course and only by e-mail to reception@opencontext.eu. The client will be refunded 60% of the total amount if he cancels more than 30 days before the start of the course; 40% if he cancels between 30 and 21 days before the start of the course; 20% if he cancels between 20 and 10 days before the start of the course; and 0% if he cancels less than 10 days before the start of the course.
Article 7: Privacy policy
7.1
By using the information and services on nextcontext.eu, you agree to our Privacy Policy and the terms and conditions contained therein.
Article 8: Advertising
8.1
When you participate in our language courses, photos or videos of the sessions may be taken for public or commercial purposes. If you do not wish to be photographed, you can make this known by sending a simple request by e-mail. In this case, the photographer will not photograph you in a recognizable way.
Article 9: Non-attendance
9.1
In case of non-attendance of a small group lesson, the missed lesson will not be replaced or reimbursed. An individual lesson can be rescheduled if the student or client notifies the school at least 24 hours (excluding weekends and holidays) before the start of the lesson by sending an e-mail to reception@opencontext.eu.
Article 10: Attitude
10.1
It is in everyone's interest that the lessons take place in an efficient manner. First and foremost, students and teachers should treat each other with mutual respect. NextContext reserves the right to cancel an agreement if a student's behavior does not comply with this. In such a case, NextContext will claim the enrollment fee (already paid or still due) as compensation.
Article 11: Final clauses
11.1
The general terms and conditions of NextContext are governed by Belgian law. In the event of a dispute concerning the provisions of these terms and conditions, the courts of the judicial district of Gand, section Termonde, will be appointed to settle the dispute.
11.2
The annulment of a clause of these conditions does not imply the annulment of these conditions. In this case, the parties must ensure that the clause is replaced by a valid clause which, within the limits of the law, has the same effect as the clause which has been declared null and void.
